QUESTION PRESENTED

Whether the Defendants are entitled to summary judgment on all of Plaintiffs’ claims for injunctive and declaratory relief because the undisputed factual record shows that the admissions practices of the University of Michigan College of Literature, Science and the Arts — practices which involve the “competitive consideration of race” as a “single though important factor” in order to achieve the benefits of a diverse student body — satisfy the standards set out in Justice Powell’s controlling opinion in Regents of the University of California v. Bakke, 438 U.S. 265 (1978).
