RESPONSE OF DEFENDANTS REGENTS OF THE
UNIVERSITY OF MICHIGAN, ET AL. TO
MOTION TO INTERVENE

This case challenges the right of the University of Michigan Law School to use race as part of a broad array of qualifications and characteristics in making admissions decisions. The defendants will vigorously defend this case. The Proposed Defendant-Intervenors have a substantial interest in the subject matter of this litigation and defendants do not oppose the Motion to Intervene. However, defendants recognize that the participation of intervenors in this matter and in Gratz v. Bollinger, which is a subject of a motion pending before Judge Duggan, could significantly complicate discovery and possibly other aspects of these cases.

Dated:   April 23, 1998

Respectfully submitted,
