DEFENDANTS RENEWED MOTION FOR SUMMARY JUDGMENT
AS TO PLAINTIFFS CLAIMS FOR INJUNCTIVE AND DECLARATORY RELIEFPursuant to Fed. R. Civ. P. 56 and Local Rule 7.1, and for the reasons set forth in the attached Memorandum of Law, Defendants, Lee Bollinger, James Duderstadt, and the Regents of the University of Michigan, hereby renew their earlier motion for summary judgment as to Plaintiffs claims for injunctive and declaratory relief.
As is set forth in the accompanying Memorandum, there is no genuine issue of material fact at the close of extensive discovery. The record evidence in this case confirms that the state interest in achieving the educational benefits that flow from a racially and ethnically diverse student body is compelling and that the University of Michigans admissions program is entirely consistent with the standards that the Supreme Court set forth in Regents of the University of California v. Bakke, 438 U.S. 265 (1978), for devising an admissions policy that considers race and ethnicity as one of many factors in selecting a student body.
Pursuant to Local Rule 7.1(a), Defendants state that, on April 29, 1999, concurrence in their initial summary judgment motion and the relief sought therein was requested from plaintiffs counsel and such concurrence was not granted.
